1. DEFINITION AND TYPES OF COOKIES

According to the definition on Wikipedia: A cookie is a small piece of information sent by a website and stored in the user’s browser such that the website can look up the user’s previous activity.

The use of cookies is a common and safe practice and it is essential for the Internet to work well, providing as it does advantages in the provision of interactive services, making it easier to browse and use the website. Cookies cannot damage your machine, they only contain data that are innocuous for the software since they contain no code.

There are different types of Cookies, which may be split into three categories:

A. Types of cookies according to the entity managing them

According to who the entity is that is managing the machine or domain whence the cookies and processes the data that are obtained, the following types may be identified:

• Own cookies: Those that are sent to the user’s terminal equipment from a computer or domain that is managed by the editor itself and from which the service requested by the user is provided.
• Third-party cookies: Those that are sent to the user’s terminal equipment from a computer or domain which is not managed by the publisher, but by another entity that processes the data obtained through the cookies.

If the cookies are installed from a machine or domain managed by the publisher itself but the information collected by them is managed by a third party, they cannot be considered own cookies.

B. Types of cookies according to the length of time they remain active

According to the length of time that cookies remain active on a computer, we can categorise them as follows:

• Session cookies: They are a type of cookie designed to collect and store data when a user is accessing a web page.

They are often used to store information that is only useful for the provision of a service requested by the user on a single occasion (such as a list of purchased products).

• Persistent cookies: They are cookies in which the data is still stored in the terminal and can be accessed and processed during a period defined by the person responsible for the cookie, and which can range from a few minutes to several years.

C. Types of cookies according to their purpose

Depending on the purpose for which the data obtained via the cookies has been processed, we can categorise them as follows:

• Technical cookies: These allow a user to navigate through a web page, platform or application and use the different options or services there such as, for example, controlling traffic and data communication, identifying the session and accessing parts which are restricted access, remembering the elements that make up an order, carrying out the purchase process of an order, carrying out the application for registration or participation in an event, using security elements during navigation, storing content for the broadcast of videos or sound or sharing content through social networks.
• Personalised cookies: These allow the user to access the service with some predefined general characteristics based on a series of criteria in the user’s terminal such as, for example, the language, the type of browsing through which the service is accessed, the regional settings from where the service is accessed, etc.
• Analysis cookies: These cookies are used to monitor and analyse the behaviour of the users of websites on which they are linked. The information collected by this type of cookie is used to measure the activity of websites, applications or platforms and to create navigation profiles of the users of these sites, applications and platforms. This is done in order for improvements to be made relating to the analysis of the usage data made by the users of the service.

With respect to the processing of data collected through the analytical cookies, despite their not being exempt from the duty to obtain informed consent for their use, it is unlikely they represent a risk for the users’ privacy as long as they are first part cookies, which process aggregate data for a strictly statistical purpose, information is provided about their use and the possibility is included that the users state their rejection of their use.

• Advertising cookies: These allow the management, in the most efficient way possible, of the advertising space that, where appropriate, that the editor has included in a web page, application or platform from which it provides the requested service based on criteria such as edited content or the frequency at which ads are displayed.
• Behavioural advertising cookies: These allow the management, in the most efficient way possible, of the advertising space that, where appropriate, that the editor has included in a web page, application or platform from which it provides the requested service. These cookies store information on the behaviour of users obtained through the continuous observation of their browsing habits, which allows for the development of a specific profile to then display advertising.

2. COOKIES SUBJECT TO THE REGULATIONS AND EXEMPTED COOKIES

According to the EU directive, cookies that require the informed consent of the user are analytical cookies and advertising and affiliate cookies, except for technical cookies and those necessary for the website to operate or the provision of services expressly requested by the user.
